The client worked for a security company. Whilst attending a job, he asked one of the young female employees onsite to assist him to locate a power source. The employee later told a friend that the client had touched her on the leg and bottom.
The matter went to the Magistrates’ Court for a contested hearing. We arranged for the client’s boss to give evidence as to his character, highlighting his outstanding service of over 10 years to the company and confirming his unblemished record.
The victim was cross-examined and it was revealed that she had a history of mental health issues. The victim’s friend was also cross-examined. During that cross-examination he added to his original statement to police, casting doubt on his credibility and inferring he had since colluded with the victim.
These facts were enough for the Magistrate to find reasonable doubt existed. The client was acquitted and the police were ordered to pay the client’s legal costs.
