It was alleged that the client had broken into his ex-partner’s house, talked with her for an hour, then attacked her, digitally and orally raping her. From the outset the client accepted that he had injured his ex-partner but said that the sex was consensual.
Following a very detailed psychological report, and after intensive negotiations with the Crown, the Intentionally Causing Serious Injury charge was downgraded to Recklessly Causing Serious Injury, and the rest of the charges were withdrawn.
After the client pleaded guilty in the County Court, Her Honour imposed a two year gaol sentence wholly suspended for a period of two years. Had the client pleaded guilty to the original charges he would have been contemplating eight years imprisonment with a non-parole period of five years.
