Have you been advised that your unpaid infringement has been turned into an enforcement order?
If so, this means that:
- an infringement has been issued that has not been paid;
- an infringement penalty reminder notice has been issued and the infringement has still not been paid; and
- the infringement has been referred to the Infringements Court and an enforcement order has been made.
You are required to take action in relation to the enforcement order. You can either apply to the Infringements Court to have the enforcement order revoked or you can pay the enforcement order with the extra penalty costs added.
If the enforcement order relates to e-Tag then your $5 trip will have turned into $200 plus each day you travelled on the toll road and did not pay. If you do not take any action in relation to the enforcement order then the matter will go to an infringement warrant and you may be pursued by the Sheriff.
If the Sheriff catches up with you after the matter has proceeded to an infringement warrant, a number of different things can occur, but it is likely you will be given 7 days notice to pay or be bailed to attend Court. If you are bailed to appear at Court then there is the possibility that you could go to gaol for not paying the original infringement/s.
