onus of proof

In criminal cases (aside from some statutory exceptions), the onus of proof is the requirement of the prosecution to prove the accused’s guilt. (See He Kaw Teh v R (1985) 157 CLR 523; Chugg v Pacific Dunlop Ltd (1990) 170 CLR 249).
