Drug Trafficking, Possess a Drug of Dependence and Possess Proceeds of Crime.
A Legal Aid duty solicitor had initially appeared for the client at the Magistrates’ Court and unfortunately for the client, things did not go his way. At the time this case proceeded the client was on bail for other drug trafficking matters, and so he was sentenced to nine months imprisonment. Two months were to be served immediately with the rest wholly suspended for a period of two years.
By the time the appeal came before the County Court, the previous matters had been withdrawn. Despite the fact that these were prior matters, and therefore should not have been taken into account, His Honour denied bail on the basis of risk. When the client pleaded guilty to the new charge, he sentenced him to immediate imprisonment.
By the time the matter came to the County Court, we had got the client out on bail and had requested that the client do a number of things demonstrating significant rehabilitation. When the matter came before the Judge the client received a work only Community Corrections Order for 15 months with 200 hours of community service. It was an outstanding outcome.
